Overview
Solo Logs is a social wine journaling application ("App") operated by CCQuel Inc. ("we," "us," or "our"). The App allows users to log wine tasting notes, scan wine labels, participate in collaborative tasting sessions, and share their wine journey with others.
By creating an account or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. We reserve the right to update these Terms at any time by posting the revised version within the App. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
Section 1 – Eligibility and Age Requirement
Legal Drinking Age Requirement: You must be at least 21 years of age (or the legal drinking age in your jurisdiction, whichever is greater) to create an account and use Solo Logs. By creating an account, you represent and warrant that you meet this age requirement.
No Minor Access: Solo Logs is not intended for use by anyone under the legal drinking age. You may not allow minors to access or use your account. We reserve the right to terminate any account we reasonably believe is being used by or on behalf of a minor.
Legal Compliance: You agree to use the App only for lawful purposes. You may not use Solo Logs to promote underage drinking, facilitate the unlicensed sale of alcohol, or engage in any activity that violates applicable laws or regulations.
Section 2 – Account Registration and Security
To use Solo Logs, you must create an account by providing a valid email address. We use a passwordless authentication system that sends a one-time passcode (OTP) to your email for each login.
Account Responsibility: You are responsible for maintaining the security of your email account and for all activity that occurs under your Solo Logs account. You agree to notify us immediately at support@sipnotes.app if you suspect unauthorized access to your account.
Accurate Information: You agree to provide accurate and current information when creating your account and to update it as necessary.
Section 3 – User-Generated Content
Solo Logs allows you to create and share content including wine tasting notes, ratings, reviews, photos, and Session contributions (collectively, "User Content").
Ownership: You retain ownership of the User Content you create. However, by posting User Content on Solo Logs, you grant CCQuel Inc. a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and improving the App. This license ends when you delete your User Content or your account, except where your content has been shared with others or used in aggregated, anonymized datasets.
Aggregated Data: We may use anonymized, aggregated data derived from User Content (such as average ratings, regional wine trends, and tasting patterns) for analytics, product improvement, and research purposes. This aggregated data will not identify you personally.
Responsibility: You are solely responsible for your User Content and represent that it does not violate any third-party rights or applicable laws.
Accuracy of Wine Information: Wine information displayed in the App may not be fully accurate and should not be relied upon for allergy, dietary, or health-related decisions. You should verify critical information independently.
Section 4 – Sessions (Collaborative Tasting Feature)
Solo Logs includes a "Sessions" feature that allows users to participate in group wine tastings and share notes collaboratively.
Shared Content: When you contribute to a Session, your tasting notes and ratings become visible to other Session participants. You acknowledge that other participants may view, reference, and discuss your contributions within the Session context.
Session Data: If you leave a Session, your prior contributions may remain visible to other participants. You may request deletion of your Session contributions by contacting us at support@sipnotes.app.
Session Host Responsibilities: If you create a Session, you are responsible for managing participant access and ensuring that all participants meet the age requirements outlined in Section 1.
Section 5 – Prohibited Conduct
You agree not to:
- Upload content that features minors consuming alcohol or any content that encourages excessive, irresponsible, or underage consumption;
- Use automated tools, bots, scrapers, or similar technology to access, scrape, or extract data from Solo Logs, including the wine database or user review data;
- Harass, abuse, threaten, or intimidate other users;
- Impersonate another person or misrepresent your identity or affiliation;
- Upload malicious code, viruses, or any software intended to damage or interfere with the App;
- Use the App for any commercial purpose without our prior written consent, including advertising, solicitation, or the sale of alcohol;
- Attempt to circumvent any security features or access restrictions of the App;
- Submit false, misleading, or fraudulent information; or
- Violate any applicable local, state, national, or international law or regulation.
We reserve the right to terminate your account for violating any of these prohibitions.
Section 6 – Subscriptions and Payments
Solo Logs may offer free and premium subscription tiers. If you purchase a premium subscription:
Billing: Subscriptions are billed through the Apple App Store or Google Play Store. Payment terms are governed by the respective platform's terms of service.
Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period through your device's subscription settings.
Refunds: Refund requests are handled by the respective app store in accordance with their refund policies.
Price Changes: We reserve the right to change subscription pricing. You will be notified of any price changes before they take effect.
Section 7 – Intellectual Property
The Solo Logs name, logo, design, and all original content, features, and functionality of the App are owned by CCQuel Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
Section 8 – Third-Party Services
Solo Logs may integrate with or contain links to third-party services, websites, or content. We are not responsible for the availability, accuracy, or content of any third-party services. Your use of third-party services is governed by their respective terms and policies.
Section 9 – Privacy and Personal Information
Your use of Solo Logs is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.
Section 10 – Push Notifications and Communications
Solo Logs may send you push notifications related to your account activity, Session invitations, and App updates. You can manage your notification preferences in the App settings or through your device settings. We may also send service-related communications via email that are necessary for the operation of your account.
Section 11 – Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE.
Section 12 – Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCQUEL INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
Section 13 – Indemnification
You agree to indemnify, defend, and hold harmless CCQuel Inc. and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, your violation of these Terms, or your violation of any rights of another.
Section 14 – Account Termination
By You: You may terminate your account at any time through the App settings or by contacting us at support@sipnotes.app.
By Us: We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.
Effect of Termination: Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
Section 15 – California Account Deletion (AB 656)
Right to Delete: In accordance with California law, you may delete your account at any time through the "Delete Account" option in the App settings.
Data Removal: Upon account deletion, CCQuel Inc. will remove your personal data and wine journal entries from our active databases within 30 days, except where retention is required by law or where data has been anonymized and aggregated.
Section 16 – Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.
Section 17 – Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CCQuel Inc. regarding your use of Solo Logs and supersede any prior agreements or understandings.
Section 18 – Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Section 19 – Changes to Terms of Service
We reserve the right to update these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Solo Logs after such changes constitutes acceptance of the updated Terms. You are encouraged to review these Terms periodically.
